Dhaka Bureau: Bangladesh Bank has been ordered to take the signatures of customers and guarantors, as well as thumb impressions, to take loans from financial institutions. The central bank issued this directive to financial institutions yesterday after giving such directives to banks earlier.
The financial institutions and market department of Bangladesh Bank has sent an instruction regarding this to all the financial institutions in the country. As per the rules, there are instructions on the execution of the loan agreement, the execution of guarantee-related charge documentation, the creation of a charge on collateral, and the execution of a mortgage on subsidiary collateral before disbursement of the loan. List of borrowers, types of loans, and collateral-based charge documents where signatures of borrowers and third parties are required. But as per the observations of the High Court, several writ petitions have been filed in the court in recent times.
Where both the borrowers and the guarantor of the loan said that they did not sign the documents related to taking the loan and being the guarantor, respectively. As a result, the legal process of debt collection is being disrupted. According to the instructions of the Central Bank, in order to resolve the legal complications in debt collection, it is necessary to ensure that the contents of the charge documents accepted for the purpose of the loan are read and heard by the borrower and guarantor and the related third parties.
Also, the documents should be verified with a signature (where applicable) as well as a thumb impression of both hands from the database maintained for the National Identity Card.
