Court Reporter: The High Court upheld the death sentence of three accused in the case of killing Himadri Majumdar by running a dog in the city. However, the court acquitted the other two accused who died in the judicial court. After the hearing on the death reference and appeal of five persons, the High Court bench consisting of Justice Bhishmadev Chakraborty and Justice Khondkar Diliruzzaman announced the verdict on Thursday (03 November).
The three accused who have been sentenced to death are Mahabub Ali Danny, Junaid Riyad and Zahidul Islam Shawon.
The acquitted accused are Shahadat Hossain and Shah Salim alias Tipu.
Assistant Attorney General Zahid Ahmed Hero was present at the hearing for the state in the court. Earlier, on April 27, 2012, the accused had abducted Himadri from in front of Summer Field School and College in Panchlaish area of the city. Himadri passed ‘A’ level from that school. The accused caught him and took him to the roof of Riyad’s father businessman Tipu’s house in Panchlaish area. After being held there and beaten, the ferocious dog licked and pushed him and threw him out. After 26 days of treatment in the hospital, Himadri died on May 23 of the same year.
His uncle Prakash Das became the plaintiff in the murder case and filed the murder case in Panchlaish police station. After the investigation, the police filed a charge sheet against the five accused in the court on October 30, 2012.
After the trial, on August 14, 2016, the fourth additional Chittagong Metropolitan Sessions Judge Md. sentenced the five accused to death. Nurul Islam. Among the accused, Junaid and Zahidul are absconding. Later, the documents came before the High Court to approve the death sentence of the accused as per the rules. Besides, the accused appealed the jail.
