A relatively &#8216;inefficient&#8217; firm is being awarded the contract for this work despite failing to submit a Performance Guarantee (PG) on time. Other contractors have expressed dissatisfaction and said that this irregularity has been done by showing the issuance and acceptance of a performance guarantee by the bank at the back date. The contracting company has resorted to this fraud in connivance with the concerned department of the bank and port authority.<\/p>\n<p style=\"text-align: justify;\">According to sources, the Chittagong Port Authority has invited tenders for the repair and maintenance of three rubber tire gantry cranes, or RTGs (used for lifting and lowering containers in the yard). The estimated cost of repair and maintenance work for 5 years of RTG No. 22, 23, and 24 is Tk 13 crore, 78 lakh, and 8 thousand. Two organizations named Project Promoters Private Limited and Saif Power Tech are considered responsive or qualified to participate in this tender.<\/p>\n<p style=\"text-align: justify;\">According to sources, Dhaka&#8217;s Project Promoters Private Limited is the lowest bidder among these two organizations. They are required by port authority to submit PG. May 21 was the last day for submission of the PG, or performance guarantee, as per the tender conditions. As 10 percent of the estimated cost, the amount of this guarantee stands at 1 crore, 37 lakh, and 88 thousand taka. Sources alleged that Project Promoters Private Limited could not submit the PG on the due date. Two days after the scheduled date, i.e., May 23, 2024, I wrote to the Chief Engineer (Mechanical) of Chittagong Port for submission of the PG. The senior officer of the concerned department of the port worked for a few extra hours even after the scheduled office hours to collect the backdated PG submissions.<\/p>\n<p style=\"text-align: justify;\">Complaints have been made that when other participating organizations strongly objected, the PG submission letter was given on the &#8216;back date&#8217; (showing May 21, 2024). This PG issue is shown from the Standard Bank Limited Agrabad Branch. Sources further allege that the bank authorities approved the said PG against the contracting firm on May 23, 2024. But this issue was shown on May 21, 2024, two days earlier. There is no scope for PG issues before approval.<\/p>\n<p style=\"text-align: justify;\">In this context, a joint director of Bangladesh Bank told the media that if the bank issues a performance guarantee against any institution, it can do so only after approval. But there is no scope for issues before approval. Doing something like this would be fraud. The concerned bank manager should be held accountable for this.<\/p>\n<p style=\"text-align: justify;\">Sources alleged that the agency that is in the process of issuing and accepting PGs through back dates is &#8216;inefficient&#8217;. I have no recent experience in port repair or maintenance work. According to the rules, if the tender conditions are not met, the work is to be awarded to the second-lowest bidder. But the mechanical department of the port has become desperate to give work to their preferred companies through irregularities.<\/p>\n<p style=\"text-align: justify;\">Chittagong Port Chief Engineer (Mechanical) Aminul Islam was called several times to inquire about irregularities in the tender, but he did not pick up. So his statement is not known.<\/p>\n<p style=\"text-align: justify;\">However, Chittagong Port Authority Secretary Omar Farooq told the media, &#8220;If PG or performance guarantee is not submitted within the stipulated date or time for the contract work, if it is submitted on a back date, it is definitely an irregularity.&#8221; In that case, it is important to see the date on which the bank approved and issued the PG, as well as the date on which the contractor submitted the PG or the port authority accepted it.
