The High Court suspended the check dishonor case of all NGOs

Dhaka Bureau: The High Court has stayed the proceedings of all check dishonor cases filed by NGOs for small loan recovery. At the same time, the court also said that from now on, no NGO can file a check dishonor case.

On Sunday (November 27) Justice Md canceled the check dishonor case filed by BRAC against a person named Elias Ali. A single High Court bench of Ashraful Kamal gave this verdict.

The court said that the NGOs have been illegally filing check dishonor cases for debt recovery. There is no law to sue for collection of small debts. They can only file suits for recovery in civil courts.

On this day, the court ordered to directly reject any NGO’s check dishonor case for collection of small loans in the future. At the same time the Micro Credit Authority is directed to monitor the micro credit activities.

Advocate Rasheduzzaman Basunia represented Ilyas Ali in the court. Advocate Jisan Mahmood and Jamiul Haque Faisal were on behalf of BRAC Bank. Apart from this, Deputy Attorney General Ashek Momen was for the state.
