The Crime Desk: From January 1991 to July 2024, a legal notice has been sent to publish the list of the number of people who have been pardoned, suspended, or reduced by the President under Article 49 of the Constitution.
On Sunday (August 25), Supreme Court lawyer Barrister Md. sent notice to Omar Farooq. This notice has been sent to the Home Secretary, Law Secretary, Cabinet Secretary, and President’s Office Secretary.
The notice said, regrettably, for many years the President has been using his power to pardon or commute the sentences of many criminals convicted of murder. Many death row convicts and life sentence convicts have been released from jail due to presidential pardon and are spreading fear in society once again as mafia dons.
“As a citizen, I/we have a right to know how, by what process, on whose recommendation or advocacy the President pardons or pardons tainted, hated, infamous convicts or pardons them.” Article 49 of the Constitution regarding pardon of the President needs to be looked into whether there is abuse of power or any political purpose or use of any political force.’
The notice also said that people need to know the source of the president’s power to pardon, the process by which he does so by any law, or what the criteria are for pardoning. Therefore, I hereby request you to provide me within 15 days of receipt of the notice the list of names and details of the process by which the President pardoned or commuted the sentences of the persons released from prison from January 1991 to July 2024. .
The notice also mentioned that if the list of those exempted from punishment is not received within the specified time, a writ will be filed in the High Court.
